Opsivia Terms of Service

1. Who we are

Opsivia is operated by Connect Nation, ABN 72 686 041 761, based at 2-3 Greenhill Road, Wayville SA 5034 ("Opsivia," "we," "us"). These Terms govern your use of the Opsivia platform (app.opsivia.com.au) and related services.

2. The service

Opsivia is a business operations platform providing inventory management, staff rostering, production tracking, invoicing, and related tools for food and hospitality businesses ("the Service"). Access is provided on a subscription basis to registered organizations ("your Organization," "you").

3. Accounts and organizations

  • You must provide accurate information when creating an account and an Organization.
  • The person who creates an Organization becomes its administrator and is responsible for managing user access within that Organization.
  • Each Organization's data is logically separated from other Organizations on the platform. You may not attempt to access another Organization's data.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

4. Subscriptions, trials, and billing

  • New Organizations receive a 7-day free trial. No payment is required during the trial.
  • After the trial ends, continued access requires an active paid subscription on one of our published tiers (Starter, Growth, Pro).
  • Subscriptions are billed monthly in advance via Stripe. Prices are in Australian Dollars (AUD) and are subject to GST where applicable.
  • You may upgrade, downgrade, or cancel your subscription at any time via the Billing page or Stripe Customer Portal. Downgrades and cancellations take effect at the end of the current billing period; we do not provide partial-period refunds except where required by Australian Consumer Law.
  • If payment fails, we may suspend access to paid features until payment is resolved, following a reasonable notice period.

5. Your data

  • You retain ownership of all data you input into the Service ("Customer Data"), including inventory records, staff details, sales records, and related business information.
  • We do not access, use, or share your Customer Data except as necessary to provide the Service, as required by law, or as you direct.
  • You are responsible for the accuracy of the data you input and for ensuring you have appropriate rights and consents to input any personal information about your staff or customers into the Service.
  • On cancellation, we retain your data for 30 days to allow reactivation, after which it may be permanently deleted.

6. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in breach of any applicable law.
  • Attempt to access, tamper with, or disrupt the Service's infrastructure or other Organizations' data.
  • Reverse-engineer, resell, or white-label the Service without our written consent.
  • Upload data that infringes the rights of any third party.

7. Availability and support

We aim to keep the Service available and reliable but do not guarantee uninterrupted access. We may perform maintenance, updates, or changes to features from time to time. Support is provided via the contact details in your account.

8. Limitation of liability

To the extent permitted by law, Opsivia's liability for any claim relating to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits or business interruption. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be excluded.

9. Termination

We may suspend or terminate your access if you materially breach these Terms, including non-payment. You may cancel your subscription and stop using the Service at any time.

10. Changes to these Terms

We may update these Terms from time to time. We'll notify you of material changes via email or in-app notice. Continued use after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of South Australia, Australia.
